What should muslims in Non-muslim countries do to determine Ramadan date ?

The third question of Fatwa no. 319
Q 3: It is impossible to see the new moon with the naked eye before 30 hours of its birth. After this period, it is impossible to see it because of the weather conditions. If this situation is taken into consideration, is it possible for the inhabitants ofEngland to use astronomical information for this country in calculating the probable time of sighting the new moon and the beginning of the month of Ramadan, or must we see the new moon (with naked eye) before starting to fast the blessed month of Ramadan?

A: It is permissible to make use of observation instruments to sight the new moon, but it is not permissible to rely on astrological sciences in confirming the beginning or end of the month of Ramadan. Allah has not legislated it either in His Book or in the Sunnah of his Prophet (peace be upon him). Rather, Allah has legislated for us to establish the beginning and end of Ramadan through sighting the new moon; to begin Sawm by seeing the new moon of Ramadan and to end Sawm by seeing the new moon of Shawwal and to gather to perform the Prayer of ‘Eid-ul-Fitr (the Festival of Breaking the Fast). Allah has made the new moons to mark fixed periods of time for mankind and for performing Hajj. So, it is not permissible for a Muslim to use any other method to determine the times for acts of worship such as fasting of Ramadan, celebrating the Two ‘Eids, going on Hajj, fasting as a Kaffarah (expiation) for killing by mistake or for committing Zhihar (a man likening his wife to an unmarriageable relative) and so on. Allah (Exalted be He) says: So whoever of you sights (the crescent on the first night of) the month (of Ramadan i.e. is present at his home), he must observe Saum (fasts) that month Allah (Exalted be He) also says: They ask you (O Muhammad صلى الله عليه وسلم) about the new moons. Say: These are signs to mark fixed periods of time for mankind and for the pilgrimage. The Prophet (peace be upon him) said: Start Sawm (fast) when you see it (the new moon of Ramadan) and stop Sawm when you see it (the new moon of Shawwal); but if the sky is overcast (and you cannot see it), complete the number of days (of Sha‘ban to thirty days). On this basis, it is obligatory upon those who do not see the new moon in their sighting place where the sky is cloudy or clear to complete thirty days of Sha‘ban, unless it is seen in another place. If the new moon is confirmed in another place, they have to follow the decision of the Muslim ruler of their country; whether to start Sawm (Fasting) or not, because his view in this issue puts an end to any disagreement among the Fuqaha’ (Muslim jurists) concerning the issue of different locations of sighting the new moon.

If their ruler is a non-Muslim, they should act according to the ruling issued by the concerned Islamic center in their country; whether to fast following the sighting of the new moon in another location or not to start fasting, considering the disagreement in different locations of sighting the new moon.

The Permanent Committee for Scholarly Research and Ifta' opines that the Muslim Students' Association in non-Muslim countries acts as an Islamic government in the matter of verifying the crescent for Muslims living in those countries. Based on what is set forth in the second article of the statement issued by the Council, this association has the right to choose between the two opinions, either considering the difference in moon sighting matters or not. Then they should publicize what they opine to the Muslims of their country who are to abide by what was opined and publicized for the sake of unity in order to begin observing Sawm on the same day, and to avoid controversy and confusion.

All Muslims who live in those countries should sight the crescent in the country in which they live. If it is witnessed by a trustworthy person or more among them, they should begin observing Sawm and should inform the Association in order for the latter to publicize the news. This is with regard to witnessing the beginning of the month. As for witnessing its end, there must be two just witnesses testifying their sighting of Shawwal crescent or else they should complete observing Sawm for thirty days, because the Messenger of Allah (peace be upon him) said: Start observing Sawm on seeing the new moon (of Ramadan), and give up Sawm on seeing the new moon (of Shawwal), and if the sky is overcast (and you cannot see it), complete the term as thirty days (of Ramadan).

A Practical Summary of How the Beginning of Ramadan is Determined

This summary is based on what is contained in the Fatāwā of the Permanent Committee for Scholarly Research and Edicts, Saudi Arabia (no.1657 et al), the Resolutions of the Council of Senior Scholars, Saudi Arabia, (no.1, no. 2) as well as a fatwā issued by Shaykh Ṣāliḥ Al-Fawzān (Arabic audio).
The Messenger of Allāh ﷺ said:
When you see [the crescent of Ramaḍān] then fast, and when you see [the crescent of Shawwāl], then stop fasting; and if it is obscured from you, then count it as 30 days.
Ṣaḥīḥ Muslim
  1. The Sharīʿah regards the sighting of the moon crescent by eye as the legitimate method of determining the beginning and ending of the fast of Ramaḍān, based on the texts (like the ḥadīth above).
  2. Astronomical calculations are not a legitimate way to determine the beginning or end of the month for worship like fasting in Ramaḍān.
  3. Scholars are agreed that the crescent appears at different times in different geographical locations, but there is a difference of opinion as to whether this variation is to be considered for fasting Ramaḍān:
  4. Some scholars say if it is confirmed that a reliable Muslim sees the crescent of Ramaḍān then it becomes obligatory on everyone else who knows of this sighting to start fasting regardless of where they are. Other scholars say every location that has a different time for moonrise must go by their own sighting.
  5. This difference of opinion is based on the interpretation of textual evidence on both sides. It is a legitimate issue of ijtihād, and is not a cause for concern. It is not known that the Ummah ever had a unified Ramaḍān or ʿEid across its expanded lands; and this was never a problem.
  6. Therefore, the Permanent Committee for Scholarly Research and Edicts views that the issue should not be agitated, but instead should remain as it is, i.e. every Muslim country should leave the decision about whether to consider different moon sighting times to their scholars, and follow what they deem to be correct based on the evidence, and the people of the country should follow what the ruler of the country does on that basis.
  7. It is not correct to specify one country or land, e.g. Makkah, as the place that everyone must go by. This would lead to Muslims who have seen the crescent in one location not starting the fast if it was not seen in that specified place, which contradicts what is commanded in the Sharīʿah.
  8. In Non-Muslim countries: the Muslims try to sight the crescent themselves, and if sighted, they should fast and inform the Islamic centre or representative Muslim body in their land. The representative body has the right to choose one of the two opinions about whether fasting is established based on any sighting or whether it must be a sighting from their own crescent locality. The centre then announces the beginning of the month to the rest of the Muslims there. The Muslims fast united based on this announcement.
  9. If they do not have an Islamic centre that takes care of the affairs of the Muslims, they fast per the nearest country to them, in the same sighting locality, where the moon is sighted.

❪🌒❫ السُّـــ☟ـــؤَال ُرقـ❪⑦①❫ـم ؟

【 هل يلزم المسلمين جميعًا في كل الدول الصيام برؤيةٍ واحدة؟ وكيف يصوم المسلمون في بعض بلاد الكفار التي ليس فيها رؤية شرعية؟ 】 


❪🌘❫ الجَــــ☟ـــوَاب ُرقـ❪⑦①❫ـم :  

 《 هذه المسألة اختلف فيها أهل العلم أي إذا رُئي الهلال في بلدٍ من بلاد المسلمين وثبتت رؤيته شرعًا، فهل يلزم بقية المسلمين أن يعملوا بمقتضى هذه الرؤية؟ فمن أهل العلم مَن قال إنه يلزمهم أن يعملوا بمقتضى هذه الرؤية، واستدلوا بعموم قوله تعالى: {فَمَن شَهِدَ مِنكُمُ الشَّهْرَ فَلْيَصُمْهُ وَمَن كَانَ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِّنْ أَيَّامٍ أُخَرَ} [البقرة من الآية:185]. ويقول النبي صلى الله عليه وسلّم: «إذا رأيتموه فصوموا».

☜ قالوا: والخطاب عام لجميع المسلمين. ومن المعلوم أنه لا يُراد به رؤية كل إنسان بنفسه؛ لأن هذا متعذِّر، وإنما المراد بذلك إذا رآه مَن يثبت برؤيته دخول الشهر. وهذا عام في كل مكان. وذهب آخرون من أهل العلم إلى أنه إذا اختلفت المطالع فلكل مكان رؤيته، وإذا لم تختلف المطالع فإنه يجب على مَن لم يروه إذا ثبتت رؤيته بمكانٍ يوافقهم في المطالع أن يعملوا بمقتضى هذه الرؤية. واستدلَّ هؤلاء بنفس ما استدلَّ به الأولون فقالوا: إن الله تعالى يقول: {فَمَن شَهِدَ مِنكُمُ الشَّهْرَ فَلْيَصُمْهُ}.

● ومن المعلوم أنه لا يُراد بذلك رؤية كل إنسان بمفرده. فيعمل به في المكان الذي رُئي فيه وفي كل مكانٍ يوافقهم في مطالع الهلال. أما مَن لا يوافقهم في مطالع الهلال فإنه لم يره لا حقيقة ولا حكمًا.. قالوا: وكذلك نقول في قول النبي صلى الله عليه وسلّم: «إذا رأيتموه فصوموا، وإذا رأيتموه فأفطِروا».

☜ فإن مَن كان في مكانٍ لا يوافق مكان الرائي في مطالع الهلال لم يكن رآه لا حقيقة ولا حكمًا، قالوا: والتوقيت الشهري كالتوقيت اليومي. فكما أن البلاد تختلف في الإمساك والإفطار اليومي، فكذلك يجب أن تختلف في الإمساك والإفطار الشهري، ومن المعلوم أن الاختلاف اليومي له أثره باتفاق المسلمين، فمن كانوا في الشرق فإنهم يُمسِكون قبل مَن كانوا في الغرب، ويُفطِرون قبلهم أيضًا.

● فإذا حكمنا باختلاف المطالع في التوقيت اليومي؛ فإن مثله تمامًا في التوقيت الشهري.

☜ ولا يمكن أن يقول قائل: إن قوله تعالى: {فَالْآنَ بَاشِرُوهُنَّ وَابْتَغُوا مَا كَتَبَ اللَّهُ لَكُمْ ۚ وَكُلُوا وَاشْرَبُوا حَتَّىٰ يَتَبَيَّنَ لَكُمُ الْخَيْطُ الْأَبْيَضُ مِنَ الْخَيْطِ الْأَسْوَدِ مِنَ الْفَجْرِ ۖ ثُمَّ أَتِمُّوا الصِّيَامَ إِلَى اللَّيْلِ}.[البقرة:١٨٧]

☜ وقوله صلى الله عليه وسلم: «إذا أقبل الليل من هاهنا، وأدبر النهار من هاهنا، وغربت الشمس فقد أفطر الصائم» (رواه البخاري: [1954]، ومسلم: [2526]). لا يمكن لأحد أن يقول إن هذا عام لجميع المسلمين في كل الأقطار.

● وكذلك نقول في عموم قوله تعالى: {فَمَن شَهِدَ مِنكُمُ الشَّهْرَ فَلْيَصُمْهُ}، وقوله صلى الله عليه وسلم: «إذا رأيتموه فصوموا، وإذا رأيتموه فأفطِروا».

☜ وهذا القول -كما ترى- له قوَّته بمقتضى اللفظ والنظر الصحيح والقياس الصحيح أيضًا، قياس التوقيت الشهري على التوقيت اليومي.

● وذهب بعض أهل العلم إلى أن الأمر معلَّق بولي الأمر في هذه المسألة، فمتى رأى وجوب الصوم أو الفطر مستندًا بذلك إلى مستندٍ شرعي فإنه يعمل بمقتضاه؛ لئلا يختلف الناس ويتفرَّقوا تحت ولاية واحدة. واستدلَّ هؤلاء بعموم الحديث. «الصوم يوم يصوم الناس، والفِطر يوم يُفطِر الناس» (رواه الترمذي: [697]، وصحَّحه الألباني).

☜ وهناك أقوال أخرى ذكرها أهل العلم الذين ينقلون الخلاف في هذه المسألة.

● وأما الشق الثاني من السؤال وهو: كيف يصوم المسلمون في بلاد الكفار التي ليس بها رؤية شرعية؟


☜ فإن هؤلاء يمكنهم أن يُثبتوا الهلال عن طريق شرعي، وذلك بأن يتراءوا الهلال إذا أمكنهم ذلك، فإن لم يمكنهم هذا فإن قلنا بالقول الأول في هذه المسألة فإنه متى ثبتت رؤية الهلال في بلدٍ إسلامي، فإنهم يعملون بمقتضى هذه الرؤية، سواءً رأوه أو لم يروه.

☜ وإذا قلنا بالقول الثاني، وهو اعتبار كل بلد بنفسه إذا كان يُخالِف البلد الآخر في مطالع الهلال، ولم يتمكنوا من تحقيق الرؤية في البلد الذي هم فيه، فإنهم يعتبرون أقرب البلاد الإسلامية إليهم، لأن هذا أعلى ما يمكنهم العمل به. 》
