Ramadan or Sha'ban 15 ?

Fatwa no. 2122
Q: Allah (Exalted be He) says (what means): Hâ.-Mîm. [These letters are one of the miracles of the Qur’ân and none but Allâh (Alone) knows their meanings]. By the manifest Book (this Qur’ân) that makes things clear. We sent it (this Qur’ân) down on a blessed night [(i.e. night of Al-Qadr, Sûrah No. 97) in the month of Ramadân - the 9th month of the Islâmic calendar]. Verily, We are ever warning [mankind that Our Torment will reach those who disbelieve in Our Oneness of Lordship and in Our Oneness of worship]. I have read in “Tafsir Al-Jalalayn” by Jalal Al-Din Al-Mahallyand Jalal Al-Din Al-Suyuty the interpretation of Allah’s Words: We sent it (this Qur’ân) down on a blessed night [(i.e. night of Al-Qadr, Sûrah No. 97) in the month of Ramadân - the 9th month of the Islâmic calendar]. explaining that the Ayah (Qur’anic verse) refers to either Laylat-ul-Qadr (the Night of Decree) or the middle night of Sha‘ban, when the Qur’an was sent down from the Mother of the Book (i.e. Al-Lawh Al-Mahfuz) in the seventh heaven to the nearest (lowest) heaven. I inquired about this matter and asked many shaykhs who told me that it denotes Laylat-ul-Qadr in Ramadan. Kindly provide us with a clear explanation of this Ayah, may Allah protect you.
A: Allah (Exalted is His Majesty) swears by His Glorious Book - the miracle and the inexcusable evidence He revealed to Muhammad (peace be upon him) to support his Message - that He sent down

the Glorious Qur’an in a blessed night full of bounties, namely, Laylat-ul-Qadr. Allah says: Verily, We have sent it (this Qur’ân) down in the night of Al-Qadr (Decree). And what will make you know what the night of Al-Qadr (Decree) is? The night of Al-Qadr (Decree) is better than a thousand months (i.e. worshipping Allâh in that night is better than worshipping Him a thousand months, i.e. 83 years and 4 months). to the end of the Surah. This Night was in the month of Ramadan, because Allah (Exalted be He) says: The month of Ramadan in which was revealed the Qur’ân, a guidance for mankind and clear proofs for the guidance and the criterion (between right and wrong). Anyone who claims that it is the middle night of Sha‘ban is mistaken, as they have contradicted the Qur’an and the authentically reported Prophetic Hadith which have specified the month and mentioned it by name. Moreover, those who claim it is the middle night of Sha‘ban have no dependable proof from the Qur’an or Sunnah (whatever is reported from the Prophet) supporting their claim. In addition, this is not a reasoning or speculative issue open to debate nor is built on logic-based evidence, rather it is aurally communicated depending on what is said in the Qur’an and authentically reported in the Sunnah. Allah (Glorified be He) then shows the Justice of His Law and His All-Embracing Mercy towards His servants when He says: Verily, We are ever warning [mankind that Our Torment will reach those who disbelieve in Our Oneness of Lordship and in Our Oneness of worship].Meaning that Allah shall send messengers to convey His Laws and guide mankind to their Lord. They shall warn them against the end of disobeying His Commands and neglecting His Prohibitions. All this in order to establish Divine Justice, leaving no excuse to mankind after messengers, who are sent out of Allah’s Mercy towards His servants. Allah (Exalted be He) says: Messengers as bearers of good news as well as of warning in order that mankind should have no plea against Allâh after the (coming of) Messengers. And Allâh is Ever All-Powerful, All-Wise. He also says: This is because your Lord would not destroy the (populations of) towns for their wrong-doing (i.e. associating others in worship along with Allâh) while their people were unaware (so the Messengers were sent).

He (Exalted be He) says: Whoever goes right, then he goes right only for the benefit of his ownself. And whoever goes astray, then he goes astray to his own loss. No one laden with burdens can bear another’s burden. And We never punish until We have sent a Messenger (to give warning).

ما معنى الإنزال في قوله تعالى إنّا انزلناه في ليلة القدر ؟

" الصحيح أن معناها: ابتدأنا إنزاله في ليلة القدر، وليلة القدر في رمضان لا شك في هذا ودليل ذلك قوله تعالى: {شهر رمضان الذي أنزل فيه القرآن هدى للناس وبينات من الهدى والفرقان} [البقرة: 185] .
فإذا جمعت هذه الآية أعني {شهر رمضان الذي أنزل فيه القرآن} إلى هذه الآية: {إنا أنزلناه في ليلة القدر} تبين أن ليلة القدر في رمضان، وبهذا نعرف أن ما اشتهر عند بعض العامة من أن ليلة القدر هي ليلة النصف من شهر شعبان لا أصل له، ولا حقيقة له، فإن ليلة القدر في رمضان، وليلة النصف من شعبان كليلة النصف من رجب، وجمادى، وربيع، وصفر، ومحرم وغيرهن من الشهور لا تختص بشيء، حتى ما ورد في فضل القيام فيها فهو أحاديث ضعيفة لا تقوم بها حجة، وكذلك ما ورد من تخصيص يومها وهو يوم النصف من شعبان بصيام فإنها أحاديث ضعيفة لا تقوم بها حجة، لكن بعض العلماء ـ رحمهم الله ـ يتساهلون في ذكر الأحاديث الضعيفة فيما يتعلق بالفضائل: فضائل الأعمال، أو الشهور، أو الأماكن وهذا أمر لا ينبغي، وذلك لأنك إذا سقت الأحاديث الضعيفة في فضل شيء ما، فإن السامع سوف يعتقد أن ذلك صحيح، وينسبه إلى الرسول عليه الصلاة والسلام وهذا شيء كبير، فالمهم أن يوم النصف من شعبان وليلة النصف من شعبان لا يختصان بشيء دون سائر الشهور، فليلة النصف لا تختص بفضل قيام، وليلة النصف ليست ليلة القدر، ويوم النصف لا يختص بصيام، نعم شهر شعبان ثبتت السنة بأن النبي صلى الله عليه وسلّم يكثر الصيام فيه حتى لا يفطر منه إلا قليلاً (1) وما سوى ذلك مما يتعلق بصيامه لم يثبت عن النبي صلى الله عليه وسلّم إلا ما لسائر الشهور كفضل صوم ثلاثة أيام من كل شهر (2)وأن تكون في الثالث عشر، والرابع عشر، والخامس عشر، وهي أيام البيض."

Know! That the meaning of the Ayaah in which Allaah, the Most High, says:

We sent it (this Qur'an) down on a blessed night [(i.e. night ofQadr, Surah No: 97) in the month of Ramadan,, the 9th month of the Islamic calendar]. Verily, We are ever warning [mankind that Our Torment will reach those who disbelieve in Our Oneness of Lordship and in Our Oneness of worship]. Therein (that night) is decreed every matter of ordainments.
[ad-Dukhaan 44:3-4]

This night refers to Layla al-Qadr or the Night of Power in Ramadhaan. Some said it refers to the fifteenth of Sha’baan however the majority say this Ayaah applies to the Night of Power in Ramadhaan and this is the truth.

Haafidh Ibn Katheer said, “Saying that this night in the Aayah refers to the fifteenth of Sha’baan is far from the truth. Rather, the textual proofs from the Quraan prove that it refers to the night in Ramadhaan.” End Quote

In the Sharh of Mishkaat, it is stated that a number of the Salaf held that the opinion that the Ayaat above refer to the fifteenth of Sha’baan however what it is apparent is that the Quraan itself refutes this view. The Quraan clearly states that it was revealed in the month of Ramadhaan, in further detailed, it also states that the Quraan was revealed on the Night of Power and no scholars differed on this fact. Once this is established it becomes apparent that the Night of Decrees cannot be in the night of the fifteenth of Sha’baan.

-ﺍﻟﻨﻘﻄﺔ ﺍﻟﺜﺎﻟﺜﺔ: ﻓﻀﻞ ﻟﻴﻠﺔ ﺍﻟﻨﺼﻒ ﻣﻨﻪ ﻭﻫﺬﺍ ﺃﻳﻀًﺎ ﻓﻴﻪ ﺃﺣﺎﺩﻳﺚ ﺿﻌﻴﻔﺔ ﻻ ﺗﺼﺢ ﻋﻦ ﺍﻟﻨﺒﻲ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﻋﻠﻰ ﺁﻟﻪ ﻭﺳﻠﻢ؛ ﻭﻋﻠﻰ ﻫﺬﺍ ﻓﻠﻴﻠﺔ ﺍﻟﻨﺼﻒ ﻣﻦ ﺷﻌﺒﺎﻥ ﻛﻠﻴﻠﺔ ﺍﻟﻨﺼﻒ ﻣﻦ ﺭﺟﺐ ﺃﻭ ﻣﻦ ﺭﺑﻴﻊ ﺃﻭ ﻣﻦ ﺟﻤﺎﺩﻯ ﺃﻭ ﻣﻦ ﻏﻴﺮﻫﻦّ ﻣﻦ ﺍﻟﺸﻬﻮﺭ، ﻻ ﺗﻤﺘﺎﺯ ﻫﺬﻩ ﺍﻟﻠﻴﻠﺔ -ﺃﻋﻨﻲ: ﻟﻴﻠﺔ ﺍﻟﻨﺼﻒ ﻣﻦ ﺷﻌﺒﺎﻥ- ﺑﺸﻲﺀ ﺑﻞ ﻫﻲ ﻛﻐﻴﺮﻫﺎ ﻣﻦ ﺍﻟﻠﻴﺎﻟﻲ؛ ﻷﻥ ﺍﻷﺣﺎﺩﻳﺚ ﺍﻟﻮﺍﺭﺩﺓ ﻓﻲ ﺫﻟﻚ ﺿﻌﻴﻔﺔ.

-ﺍﻟﻨﻘﻄﺔ ﺍﻟﺮﺍﺑﻌﺔ: ﺗﺨﺼﻴﺼﻬﺎ ﺑﻘﻴﺎﻡ ﻭﻫﺬﺍ ﺃﻳﻀًﺎ ﺑﺪﻋﺔ؛ ﻷﻧﻪ ﻟﻢ ﻳﺮﺩ ﻋﻦ ﺍﻟﻨﺒﻲ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﻋﻠﻰ ﺁﻟﻪ ﻭﺳﻠﻢ ﺃﻧﻪ ﻛﺎﻥ ﻳﺨﺼّﺺ ﺗﻠﻚ ﺍﻟﻠﻴﻠﺔ ﺑﻘﻴﺎﻡ ﺑﻞ ﻫﻲ ﻛﻐﻴﺮﻫﺎ ﻣﻦ ﺍﻟﻠﻴﺎﻟﻲ.

-ﺍﻟﻨﻘﻄﺔ ﺍﻟﺨﺎﻣﺴﺔ: ﻫﻞ ﻳﻜﻮﻥ ﺗﻘﺪﻳﺮ ﺍﻟﻘﻀﺎﺀ ﻓﻲ ﻫﺬﻩ ﺍﻟﻠﻴﻠﺔ؟ ﺑﻤﻌﻨﻰ: ﻫﻞ ﻳﻘﺪّﺭ ﻓﻲ ﺗﻠﻚ ﺍﻟﻠﻴﻠﺔ ﻣﺎ ﻳﻜﻮﻥ ﻓﻲ ﺗﻠﻚ ﺍﻟﺴﻨﺔ؟
ﻭﺍﻟﺠﻮﺍﺏ: ﻻ، ﻟﻴﺴﺖ ﻟﻴﻠﺔ ﺍﻟﻘﺪﺭ؛ ﻟﻴﻠﺔ ﺍﻟﻘﺪﺭ ﻓﻲ ﺭﻣﻀﺎﻥ، ﻗﺎﻝ ﺍﻟﻠﻪ ﺗﻌﺎﻟﻰ: ﴿ﺇِﻧَّﺎ ﺃَﻧْﺰَﻟْﻨَﺎﻩُ﴾ ﺃﻱ ﺍﻟﻘﺮﺁﻥ ﴿ﺇِﻧَّﺎ ﺃَﻧْﺰَﻟْﻨَﺎﻩُ ﻓِﻲ ﻟَﻴْﻠَﺔِ ﺍﻟْﻘَﺪْﺭِ ‏(١) ﻭَﻣَﺎ ﺃَﺩْﺭَﺍﻙَ ﻣَﺎ ﻟَﻴْﻠَﺔُ ﺍﻟْﻘَﺪْﺭِ ‏(٢) ﻟَﻴْﻠَﺔُ ﺍﻟْﻘَﺪْﺭِ ﺧَﻴْﺮٌ ﻣِﻦْ ﺃَﻟْﻒِ ﺷَﻬْﺮٍ﴾ ‏[ ﺍﻟﻘﺪﺭ: ١-٣] ، ﻭﻗﺎﻝ ﺍﻟﻠﻪ ﺗﻌﺎﻟﻰ: ﴿ﺷَﻬْﺮُ ﺭَﻣَﻀَﺎﻥَ ﺍﻟَّﺬِﻱ ﺃُﻧْﺰِﻝَ ﻓِﻴﻪِ ﺍﻟْﻘُﺮْﺁَﻥُ﴾ ‏[ ﺍﻟﺒﻘﺮﺓ: ١٨٥‏]، ﻭﻋﻠﻰ ﻫﺬﺍ ﻓﺘﻜﻮﻥ ﻟﻴﻠﺔ ﺍﻟﻘﺪﺭ ﻓﻲ ﺭﻣﻀﺎﻥ؛ ﻷﻧﻬﺎ ﺍﻟﻠﻴﻠﺔ ﺍﻟﺘﻲ ﺃﻧﺰﻝ ﺍﻟﻠﻪ ﻓﻴﻬﺎ ﺍﻟﻘﺮﺁﻥ ﻭﺍﻟﻘﺮﺁﻥ ﻧﺰﻝ ﻓﻲ ﺷﻬﺮ ﺭﻣﻀﺎﻥ ﻓﻴﺘﻌﻴّﻦ ﺃﻥ ﺗﻜﻮﻥ ﻟﻴﻠﺔ ﺍﻟﻘﺪﺭ ﻓﻲ ﺭﻣﻀﺎﻥ ﻻ ﻓﻲ ﻏﻴﺮﻩ ﻣﻦ ﺍﻟﺸﻬﻮﺭ ﻭﻣﻦ ﺫﻟﻚ ﻟﻠﻴﻠﺔ ﺍﻟﻨﺼﻒ ﻣﻦ ﺷﻌﺒﺎﻥ ﻓﺈﻧﻬﺎ ﻟﻴﺴﺖ ﻟﻴﻠﺔ ﺍﻟﻘﺪﺭ ﻭﻻ ﻳﻘﺪّﺭ ﻓﻴﻬﺎ ﺷﻲﺀ ﻣِﻤّﺎ ﻳﻜﻮﻥ ﻣﻦ ﺗﻠﻚ ﺍﻟﺴﻨﺔ ﺑﻞ ﻫﻲ ﻛﻐﻴﺮﻫﺎ ﻣﻦ ﺍﻟﻠﻴﺎﻟﻲ.

-ﺍﻟﻨﻘﻄﺔ ﺍﻟﺴﺎﺩﺳﺔ: ﺻﻨﻊ ﺍﻟﻄﻌﺎﻡ ﻳﻮﻡ ﺍﻟﻨﺼﻒ؛ ﻓﺈﻥ ﺑﻌﺾ ﺍﻟﻨﺎﺱ ﻳﺼﻨﻊ ﻃﻌﺎﻣًﺎ ﻓﻲ ﻳﻮﻡ ﺍﻟﻨﺼﻒ ﻣﻦ ﺷﻌﺒﺎﻥ ﻳﻮﺯّﻋﻪ ﻋﻠﻰ ﺍﻟﻔﻘﺮﺍﺀ ﻭﻳﻘﻮﻝ: ﻫﺬﺍ ﻋﺸﺎﺀ ﺍﻷﻡ، ﻫﺬﺍ ﻋﺸﺎﺀ ﺍﻷﺏ ﺃﻭ ﻫﺬﺍ ﻋﺸﺎﺀ ﺍﻟﻮﺍﻟﺪَﻳْﻦ ﻭﻫﺬﺍ ﺃﻳﻀًﺎ ﺑﺪﻋﺔ؛ ﻷﻧﻪ ﻟﻢ ﻳﺮﺩ ﻋﻦ ﺍﻟﻨﺒﻲ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﻋﻠﻰ ﺁﻟﻪ ﻭﺳﻠﻢ ﻭﻻ ﻋﻦ ﺍﻟﺼﺤﺎﺑﺔ ﺭﺿﻲ ﺍﻟﻠﻪ ﻋﻨﻬﻢ.
