Offering Tarawih prayer with Jam'ah in the masjid is better (for men)

Offering Tarawih Prayer at home


Q 4: The month of Ramadan has come and it is time to offer Tarawih (special supererogatory night Prayer in Ramadan), is it better to go and attend it in the Masjid (Mosque) or offer it at home?


I am not an Imam (the one who leads congregational Prayer), but a Ma’mum (person being led by an Imam in Prayer). 


I love to recite the Qur’an and prefer reciting to listening. 


Is there any sin if I pray Tarawih at home?


A: There is no sin on you if you offer Tarawih at home, because it is a Nafilah (supererogatory prayer). 

However, it is better to pray it with the Imam in the Masjid following the example of the Prophet (peace be upon him) and his Sahabah (Companions of the Prophet, may Allah be pleased with them). 

When the Prophet (peace be upon him) led his Sahabah in Tarawih on some nights until the end of the first third of the night, one of them said to him: 

We wish that you would lead us in Nafilah Prayer for the rest of the night. He (peace be upon him) replied:  

Anyone who prays Qiyam (optional Night Prayer) with the Imam until he finishes, it will be recorded for him as spending the whole night in prayer. 

(Related by Ahmad and the Compilers of the Sunan through a good Isnad [chain of narrators] from the Hadith of Abu Dhar)

Its better to recite the Entire Qur'an (30 juz') in Taraweeh (even if its by looking into the Mushaf) ا

🔖بعض الأئمة يقرؤون قصار السور ويقتصرون على ذلك في صلاة التراويح، ولا يختمون القرآن إطلاقاً، ما حكم هذا العمل؟



▪️| قَـالَ الشَّـيخ العلّامـة ابنُ بَاز -رَحِمَهُ الله-:

"... الأمر في هذا واسع والحمد لله، كل يقرأ بما يسر الله له، سواء القرآن كله أو قرأ من قصار المفصل، أو قرأ بعض السور التي يحفظها لا حرج في ذلك،

•• لكن الأفضل أن يقرأ القرآن كله إذا تيسر، ولو من المصحف، يوجد حوله كرسي ويطرح المصحف، وإذا أرد الركوع والسجود جعله على الكرسي وإذا قام قرأ، وكان ذكوان مولى عائشة رضي الله عنها يصلي بها في رمضان من المصحف،


•• والصواب أنه لا حرج في ذلك، هذا هو الصواب أنه لا حرج في أن يقرأ من المصحف ولو ترك ذلك وقرأ بسورة من جزء عم أو غيره فلا حرج في ذلك، الأمر في هذا واسع،

•• ليس من اللازم أن يختم القرآن، لو صلى بهم بعض القرآن في جميع رمضان فلا بأس في ذلك، سواء كان من قصار المفصل أو من طواله لكن الأفضل إذا تيسر له أن يختم بهم فهو الأفضل".

Reciting from the Mus-haf in Tarawih


Q: What is the ruling on reciting the Qur'an from a Mus-haf (copy of the Qur'an) during Tarawih (special supererogatory night Prayer in Ramadan)?

A: The scholars have differed over the ruling on this matter; some of them disliked it while the majority permitted it. 

In the books: "Qiyam-ul-Layl wa Qiyam Ramadan" by Shaykh Muhammad ibn Nasr Al-Marwazy, 

it is authentically reported on the authority of Ibn Abu Mulaykah that Dhakwan Abu `Amr, whom `Aishah manumitted, used to lead her and those with her in Salah during Ramadan, and he recited from a Mus-haf. 

Ibn Shihab was asked about a man who led people in Tarawih in Ramadan and recited from a Mus-haf. He replied, 

"They have done so since the beginning of Islam. The best people among us used to recite from a Mus-haf."

It was also authentically reported from Ibrahim ibn Sa`d from his father that he used to tell him to lead his family in Salah (Prayer) in Ramadan, and he told him to recite from a Mus-haf saying, "Let me hear your voice." 

It was reported from Ayyub on the authority of Muhammad that he saw no harm in someone leading Tarawih and reciting from a Mus-haf. 

`Ata' said about a man who was leading Salah in Ramadan with a Mus-haf, that "There is no harm in it." 

And Yahya ibn Sa`id Al-Ansary said, "I do not see any harm in reciting from the Mus-haf in Ramadan when wanting to perform Qiyam (standing for optional Prayer at night)." 

Ibn Wahb (may Allah be merciful to him) said, 

"Malik (may Allah be merciful to him) was asked about the people in a village where no one had memorized the Qur'an, and if they could give a Mus-haf to a man from among them to recite from. 

He said, 'There is no harm in doing so.'"

In "Al-Muntaha" and its commentary it is written: 

"A person performing Salah may recite from a Mus-haf and look at it." 

Ahmad said, "There is no harm in someone leading people in Qiyam while looking at a Mus-haf." He was asked, 

"In the Faridah (obligatory Salah)?" He said, "I have not heard anything against it." 

Al-Zuhry was asked about a man who recited from the Mus-haf in Ramadan. He replied, 

"The best among us recite from the Mus-haf."

Among those who disapproved of it were Mujahid, Ibrahim, and Sufyan. 

They disapproved of someone leading people in Ramadan reciting from the Mus-haf, fearing that they may be imitating the People of the Book. 

Muhammad ibn Nasr said in "Qiyam-ul-Layl wa Qiyam Ramadan", and "Al-Witr" that a group of people disapproved of this, 

because it was what the People of the Book used to do, so they disapproved of Muslims imitating this. 

Muhammad ibn Nasr responded to this claim of imitating them by saying that reciting from the Qur'an is far different from reading the mentioned Books, 

because reciting the Qur'an is one of the acts of Salah, while reading their Books is not.

”الذي يعجز عن القراءة حفظاً لا بأس أن يقرأه من المصحف في صلاة التراويح لأنه سيقرأ القرآن كله من أوله إلى آخره فإذا لم يكن حافظا للقرآن فإنه يقرأ من المصحف كان بعض السلف يفعل هذا“.

Importance of Niyyah in Talaq- a very dangerous issue

بسم الله الرحمن الرحيم 
إن الحمد لله رب العالمين ، و الصلاة و السلام على خاتم النبيين ، وبعد :
فلا شك أن الإسلام قد جاء بنظام متقن رصين للأسرة ، و قد أجاب عن التساؤلات التي تعرض في هذا الباب ، و وضع الحلول للإشكالات التي تعرض للأسرة المسلمة ، ومن ذلك إباحته لفسخ عقد النكاح بتشريع الطلاق ، وهذا استثناء من نظام العقود ، فإن الإسلام قد استثنى عقد النكاح بعدد من المسائل منها إيجاب الإشهاد على هذا العقد ، وإيجاب ولي المرأة ، وجواز فسخه من قبل طرف واحد ( وهو الرجل لامتلاكه للقوامة ) وإن لم يرض الطرف الآخر ، وهذا هنا على خلاف بقية العقود المنشأة في الإسلام .
فمن حكمة الله تعالى أن شرع " الإذن للرجل بالانفراد بالطلاق دون المرأة ، لما في ذلك من المصلحة الظاهرة ، فلو لم يأذن الله بذلك لكان الطلاق باطلاً كله ، إلا أن يرضى الطرفان ! كما هو في سائر العقود .
فمن طلق كما أذنه الله فقد صح طلاقه ، ومن طلق على غير ما أذن الله كان طلاقه باطلاً غير صحيح ، لأنه لا يملكه وحده بطبيعة التعاقد ، و إنما يملك ما أذنه به ربه وما ملكه إياه ، وكان عمله هذا داخلاً تحت عموم قول النبي صلى الله عليه وسلم ( من عمل عملاً ليس عليه أمرنا فهو رد ) "
[1] ، فاعرف هذا فإنه أصل مهم .
This article is to explain the importance of NIYYAH in the issue of TALAQ.

Usually TALAQ is given by the MAN who is the Maintainer (qawwam) over the women. And Divorcing his wives is his sole right. He has the power to divorce his wife when he thinks its fit to do so. There is no one who can literally stop him from divorce as it his right & power.

Men should understand the grave issues after effects of this divorce & not play around with it like kids or fools. Rather he should thank ALLAH that he has been blessed with power to exercise this right rather than misusing it to his personal benefits & cheap goals.

The important issue to be discussed here regarding TALAQ (from the husband) is :

1- Talaq occurs from the NIYYAH (intention) & expression (oral / written) confirms it.
2- Talaq occurs from the husband even if didnt reach the wife (orally / written) as long as the husband was serious (niyyah) about it & he has some evidence (recording/written) to prove it.
3- Witnessing to the Talaq is not a mandatory condition (although its recommended) for it to occur & witnessess could be informed even days or months after the talaq had occured.

Now,
these 3 issues may sound strange for many of us esp those who havent learnt this mas'ala in depth.

i will just state a few fatwas from the Kibaaril ulema to clarify these points

الإشهاد على الطلاق كتابة مع عدم إخبارها بذلك

الفتوى رقم ‏(‏4420‏)‏

س‏:‏ ما قولكم دام فضلكم في الشرع‏:‏ رجل طلق امرأته طلقة واحدة، وأشهد على نفسه كتابة، ولكن لم يخبرها بذلك، ولا الشهود أخبروها بذلك، والطلاق حصل من قبل ستة أشهر، ولم يراجعها ولا له قصد في مراجعتها، وهي مقيمة في داره مع أمها وابنها في غرفة أخرى، وهو ينام ويقعد في غرفة أخرى بالدار، وطول هذه المدة لم يحصل بينها وبينه أي شيء مما حصل بين الرجل وامرأته، وفي أغلب الأوقات تأكل وتشرب وحدها مع أمها وابنها، وهو يأكل وحده وتقوم بواجبه الخادمة، سواء يواكلها في أوقات الضرورة؛ عندما يكونون عندهم ضيوف أو غير ذلك من الضروريات، مع العلم أنه يقوم بكل ما يلزمها من مأكل ومشرب وخلافه من ضروريات الحياة، ما عدا مثل ما سبق أنه لم يعاشرها معاشرة الأزواج ولم يقربها، 

والسبب في عدم إخبارها هو أن الابن في آخر السنة للدراسة في الثانوية العامة، وبعدها يدخل الجامعة، وخوفا من أن يحصل له صدمة أو انزعاج ويسقط في الدراسة، وللمعلومية أن الزوجة لها أولاد وبنات آخرون متزوجون، وسكنهم وإقامتهم وحدهم، هذا هو الواقع‏.‏ ما حكم ذلك‏؟‏ 

أفتونا ولكم الأجر والثواب‏.‏ ونظرا إلى أن ‏(‏ع‏.‏ ج‏)‏ قد توفي، فإن ولده يسأل عن صحة هذا الطلاق‏.‏


ج‏:‏ إذا كان الواقع كما ذكر، فإن الطلاق الحاصل من ‏(‏ع‏.‏ ج‏)‏ لزوجته ‏(‏ح‏.‏ أ‏)‏ معتبر، وهو طلقة واحدة، فإذا كانت قد خرجت من العدة قبل وفاته أو كانت هذه الطلقة آخر ثلاث تطليقات- فإن الزوجة لا تعتد ولا تحد على ‏(‏ع‏.‏ ج‏)‏، ولا ترثه، أما إن كانت لم تحض ثلاث حيضات قبل وفاته، وكانت الطلقة المذكورة ليس قبلها طلقتان، فإنها لم تزل في العدة، وعليها أن تنتقل عنها إلى عدة الوفاة، وعليها أن تحاد، ولها الميراث‏.‏ وبالله التوفيق،
 وصلى الله على نبينا محمد وآله وصحبه وسلم‏.‏

FYI, 

The above fatwa from the Senior Scholars in KSA clarifies that 

TALAQ has occured from the husband eventhough he didnt inform his wife that she is divorced. 
But he was serious in his NIYYAH that he divroced her & wrote in on paper although she was still staying with him in his house ...
Later he died in that state & the Ulema had ruled that she was divorced as the husband was SERIOUSLY INTENTION of divroce as in his letter (paper).

From the above audio its clear that 

IMPORTANT ISSUE here is whther the husband was Seriously intending talaq or not ?
IF he was serious that he is infact divorcing her , talaq has occured once he says it orally (even if wife doesnt hear it) or he writes it in paper (even if she doesnt receive it) ... 
The important thing here is 
HUSBAND WAS SERIOUS ABOUT TALAQ & He proves it by oral recording or Written letter etc.

Now the 3rd issue : 

السؤال: سماحة الشيخ إذا أذنتم لي أسأل بعض الأسئلة: هل يلزم المطلق أن يشهد أحدًا على طلاقه وعلى رجعته، أو يبقى ذلك بينه وبين زوجته وبين نفسه؟

الجواب: السنة أن يشهد، لقوله تعالى: وَأَشْهِدُوا ذَوَي عَدْلٍ مِنْكُمْ وَأَقِيمُوا الشَّهَادَةَ لِلَّهِ [الطلاق:2] فالسنة أن يشهد شاهدين؛ لأن الله جل وعلا قال في سورة الطلاق: وَأَشْهِدُوا ذَوَي عَدْلٍ مِنْكُمْ [الطلاق:2] قال بعض أهل العلم: المراد به الطلاق، وقال بعضهم: المراد به الرجعة، ولا مانع من كون الآية في الأمرين جميعًا فيشهد على طلاقها ويشهد على رجعتها، فإذا طلق أشهد حتى لا ينكر ذلك؛ فإن الشيطان قد يزين له الإنكار، فإذا أشهد كان هذا من أسباب السلامة والعافية من طاعة الشيطان في إنكار الطلاق، وهكذا الرجعة، عليه أن يشهد على رجعتها؛ لأنه قد يتأخر في إبلاغ الزوجة فيكون الشهود بينة له تعينه على حصول المطلوب من الرجعة.
فالمقصود أنه يشهد على الطلاق والرجعة هذا هو المشروع. نعم.
المقدم: ومن لم يفعل هذا فعليه أن ...
الشيخ: الطلاق واقع، والرجعة صحيحة إذا راجعها في العدة وأخبرها بذلك ولو لم يشهد صحت الرجعة؛ لأن الله قال: وَبُعُولَتُهُنَّ أَحَقُّ بِرَدِّهِنَّ فِي ذَلِكَ إِنْ أَرَادُوا إِصْلاحًا [البقرة:228]، ولم يقل بشرط كذا وكذا. نعم.
المقدم: طيب لكن عليه أن يتدارك الكتابة أو ليس عليه ذلك؟
الشيخ: لا يلزمه فيما يظهر لكن لو فعل امتثالًا للأمر واحتياطًا حسن. نعم
.

So the 3rd issue of WITNESS for the TALAQ is ...
its not a condition but its recommended. TALAQ had occured even if he didnt witness.

لا يشترط الإشهاد على الطلاق ولا يجب ، فمن تلفظ بالطلاق ، وقع طلاقه ، ولو كان في غيبة الزوجة ، أو كان لا يحضره أحد من الناس ، وكذلك لو كتب الطلاق في رسالة أو ورقة بنية الطلاق ، وقع الطلاق .
وقد حُكي الإجماع على أنه لا يشترط الإشهاد على الطلاق .
قال الشوكاني رحمه الله في مسألة الإشهاد على الرجعة : " ومن الأدلة على عدم الوجوب : أنه قد وقع الإجماع على عدم وجوب الإشهاد في الطلاق ، كما حكاه الموزعي في تيسير البيان ، والرجعة قرينته ، فلا يجب فيها ، كما لا يجب فيه " انتهى من "نيل الأوطار" (6/ 300) .
وقد أمر الله تعالى بالإشهاد على الطلاق والرجعة في قوله تعالى : (فَإِذَا بَلَغْنَ أَجَلَهُنَّ فَأَمْسِكُوهُنَّ بِمَعْرُوفٍ أَوْ فَارِقُوهُنَّ بِمَعْرُوفٍ وَأَشْهِدُوا ذَوَيْ عَدْلٍ مِنْكُمْ) الطلاق/2 ، وهذا الأمر للندب والاستحباب عند جمهور الفقهاء .


قال الشيخ عبد المحسن العباد حفظه الله : " فهذا يدل على أن الإشهاد يمكن أن يُتدارك، وأنه لا يلزم أن يكون عند الطلاق ولا عند الرجعة، بل قد يطلق ثم يشهد، ويراجع ثم يشهد، وقد تكون المراجعة بالجماع؛ لأن جماع الرجل امرأته المطلقة وهي في حال عدتها مراجعة لها، وقد تكون باللفظ، لكن الإشهاد مطلوب؛ وذلك حتى يعلم أن الطلاق انتهى بالرجعة، وكذلك الطلاق " انتهى من "شرح سنن أبي داود".

So my brothers, 
Let this message be a lesson for all married men : 
1- Not to play with this dangerous issue of TALAQ
2- Not to be hasty in such life time decisions (as talaq occurs once you are serious about it & even if you dont inform your wife)
3- Make it properly with all recommended actions (not just obligatory conditions) try to bring in witness so that atleast you get some advice & feel the seriousness of the issue !

And ALSO, 
Let this be a lesson for the wives :
1- Dont mess around with your husband FOR HE HAS THE SOLE RIGHT to divorce you !
2- Talaq is in his hands & you cannot play around with him if he decided to divorce you..so rectify yourself instead of threatening him or blackmailing him !!
3- Talaq occurs even if he didnt inform you... or the witnesses. So just be careful !!!

Finally 
Marriage should a harmonious relationship built upon 
1- LOVE (mawadda)
2- RAHMA (mercy)
3-SAKEENA(tranquility)

Not like kids playing around without giving the rights of others or demanding one's right while not fulfilling his/her obligations.

May ALLAH bless the muslim spouses everywhere to live peacefully harmoniously & happily ...  

قال الإمام الألباني في الشريط الثامن من سلسلة الهدى و النور :
( لا يرتاب عاقل في أن الطلاق بالنسبة للنكاح هو كالهدِم بالنسبة للبناء، فإنسان يبني دارا ثم يهدمها، يبني دارا ينفق عليها أموال طائلة وأوقات عديدة وو تكاليف ثم ما إذا أراد هدمها ، هدمها بساعة من نهار، الهدِم أصعب من البناء، لأنه يضيع على الإنسان جهود كثيرة وكثيرة جداً، النِكاح هو بناء لأسرة حينما يتزوج المسلم فإنما يضع الأساس لإقامة أسرة مسلمة، وكلنا يعلم قول الرسول –صلى الله عليه وعلى آله وسلم- : ( لا نكاح إلا بولي وشاهِدَيْ عدل ) فأي نكاح لم يتحقق فيه الشهود العدول فلا يعتبر نكاحاً شرعياً، وهو بناء، فالطلاق الذي قلنا إنه أخطر من هذا النكاح فهو كالهدم بالنسبة للبناء، العقل والنظر السليم يؤيد أن يشترط فيه الإشهاد، ومعنى ذلك أن إنساناً ما قرر وعزم كما قال –عزّ وجلّ- : )وَإِنْ عَزَمُوا الطَّلَاقَ فَإِنَّ اللَّهَ سَمِيعٌ عَلِيمٌ ( ، عزم على الطلاق ، ولكن هذا الطلاق وضع له الشارع الحكيم شروطاً وهذه الشروط هي في الواقع كالعرقلة لمنع وقوع هذا الطلاق، لأن الطلاق –كما قلنا- يترتب من وراءه هدم الأسرة، فقال أن السُّنّـة الإشهاد، فكأن الشارع الحكيم يقول للمطلق: لو عزمت على الطلاق وأردت تنفيذه فأتي بشاهدين، كما إذا أردت أن تنكح فخذ [..] الولي وأتي بشاهدين، وإلا فلا نكاح لك ) انتهى
فإن الإشهاد على الطلاق فيه سد باب على المتلاعبين بحقوق زوجاتهم ، وفيه سد لباب المخاصمة، وكتمان كل منهما ما يلزمه بيانه ، كما سبق من كلام العلامة السعدي . و فيه الابتعاد عن الريبة وقطع للمنازعة

"Treat women kindly"

Meaning of Hadith "Treat women kindly"

Q: The Prophet (peace be upon him) said:  "Treat women kindly, for verily women were created from a rib and the most bent part of the rib is its uppermost" What is the meaning of this Hadith?

A: This Hadith is Sahih (authentic) and it was related by Al-Bukhari and Muslim in their Two Sahih Books of Hadith.

It was narrated on the authority of Abu Hurayrah (may Allah be pleased with him) that the Prophet (peace be upon him) said: Treat women kindly, for verily women were created from a rib and the most bent part of the rib is its uppermost. So treat women kindly.


This is a command to husbands, fathers, brothers, etc. To treat women kindly and not to oppress them; to give them their rights and to guide them to do good.

This is everyone's duty for the Prophet (peace be upon him) said: Treat women kindly. This is not altered by the fact that a woman may sometimes mistreat her husband or relatives because she was created from a rib as the Prophet (peace be upon him) said,

"...The most bent part of the rib is its uppermost." It is well known that the top of the rib is the part where it is attached, so the rib will have some crookedness at that point.

The meaning is that she will inevitably have some crookedness or shortcomings in her character. That it why it was related in another Hadith in the Two Sahih that the Prophet (peace be upon him) said:

I have not seen anyone more deficient in acumen and Deen (religion) than you. A cautious, sensible man can be led astray by some of you.

This is the judgment of the Prophet (peace be upon him) and the Hadith was narrated in the Two Sahih on the authority of Abu Sa`id Al-Khudry (may Allah be pleased with him).

Deficiency in acumen - as stated by the Prophet (peace be upon him) - means that the testimony of two women is equivalent to the testimony of one man, while deficiency in Deen refers to the fact that women are not able to offer Salah (Prayer) during menstruation or post-partum period.

This is what Allah has decreed for them and for which they shall not be blamed.

Women should understand this in the way that the Prophet (peace be upon him) meant it, even if a woman is knowledgeable and pious, because the Prophet (peace be upon him) did not speak of his own whims and desires, rather it was Wahy (Revelation) that was revealed to him, which he conveyed to the Ummah (nation based on one creed).

Allah (Glorified and Exalted be He) says: By the star when it goes down (or vanishes). Your companion (Muhammad صلى الله عليه وسلم) has neither gone astray nor has erred.  Nor does he speak of (his own) desire.  It is only a Revelation revealed.

Ibn Mas’ud reported: The Messenger of Allah, peace and blessings be upon him, said, “I used to forbid you from visiting the graves, but now you may visit them. Verily, they will draw your attention away from the world and remind you of the Hereafter.
